Garbage Receptacle Requirements

94.09  RECEPTACLE REQUIRED.

It shall be the duty of every owner or his agent or occupant of any house, building, flat or apartment or tenement in the village where people reside, board or lodge, or where animal or vegetable matter is prepared or served, and at all times to maintain in good order and repair and separate can for garbage, cans, bottles, ashes and similar refuse as required.

(A)    Specifications.  The can for garbage shall be watertight, with a close-fitting lid or cover, and shall have a capacity of not less than five gallons.

(B)     Deposit in street.  No garbage or refuse of any kind shall be deposited in any street, alley or public way, except as provided in this section; and no such refuse shall be so placed that it can be blown about or scattered by the wind.

(C)     Trash and garbage receptacles.  It shall be unlawful for any person to place, locate or maintain a container or receptacle for the burning of trash or storage of garbage, refuse or rubbish on or within 30 feet of any public street or sidewalk. Notwithstanding the foregoing, any person may place garbage cans or other receptacles out for collection. Such placements shall occur not earlier than 6:00 p.m. of the day preceding collection. Such receptacles shall be returned to a location which complies with the foregoing requirements of this section within 12 hours after having been emptied.
